These Terms of Service (“Terms”) govern the use of all SaaS API services, cloud server hosting, and related products (“Services”) provided by DataGo, Inc. (“we”, “us”, “our”).

By purchasing, accessing, or using our Services, you (“Customer”, “User”) agree to be bound by these Terms.

1. Eligibility

 

You must be at least 18 years old and legally able to enter into a binding agreement. You agree that all information provided to us is accurate and complete.

2. Services Provided

 

We provide SaaS API services, cloud hosting services, and any associated products or features as described on our website. We may modify, update, suspend, or discontinue any aspect of the Services at any time.

3. Account Responsibility

 

You are responsible for maintaining the confidentiality of your account, password, API keys, and any access credentials. You are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized access.

4. Billing and Payments

1. All fees are billed in advance and are due upon invoice unless otherwise stated.

2. Services may renew automatically unless cancelled before the next billing date.

3. Failure to pay may result in suspension or termination of Services.

4. Chargebacks or payment disputes may lead to immediate suspension.

5. Prices are subject to change with or without notice.

5. Refund Policy

 

5.1 SaaS API Services

 

Refunds are not guaranteed once API access is activated. If a request is made within 24–48 hours and no usage has occurred, we may offer a partial or full refund at our discretion.

 

5.2 Cloud Server Services

 

Cloud servers are generally non-refundable once provisioned. If the server has not been used (no network traffic, no login) and the request is made within 24 hours, a partial refund may be considered.

 

5.3 Violations

 

No refund is provided if Services are terminated due to abuse, fraud, chargebacks, or violation of these Terms.

 

5.4 Discretion

 

All refunds are at the sole discretion of DataGo, Inc., except where required by applicable U.S. law.

6. Acceptable Use Policy (AUP)

 

You agree not to use the Services for any activity that is illegal, harmful, or disruptive, including but not limited to:

• Fraud, identity theft, unauthorized access, or distribution of malware

• Spamming or sending unsolicited bulk messages

• Hosting or distributing prohibited content, including child exploitation, terrorism-related material, or copyrighted content without authorization

• Interfering with network operations, launching DDoS attacks, or abusing system resources

 

We reserve the right to suspend or terminate Services immediately for any violation.

7. API Usage Rules

 

API keys must remain confidential. You may not resell, share, or publicly expose your API keys or endpoints unless expressly permitted. Excessive or abusive usage may result in rate-limiting or suspension.

8. Cloud Server Usage Rules

 

You are responsible for all content hosted on your servers. Backups are your responsibility unless backup services are specifically included. We may suspend a server that causes harm, violates laws, or disrupts network stability.

9. Service Availability

 

We strive to maintain high availability but do not guarantee uninterrupted service. Outages may occur due to maintenance, network issues, or factors beyond our control. We are not liable for downtime or resulting damages.

10. Termination

 

We may suspend or terminate Services if you fail to comply with these Terms, fail to pay for Services, engage in abuse, or if required by law. Upon termination, all data may be permanently deleted.

11. Limitation of Liability

 

The Services are provided “as is” without warranties of any kind. To the maximum extent permitted by law, DataGo, Inc. is not liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid in the previous 30 days.

12. Indemnification

 

You agree to indemnify and hold DataGo, Inc. harmless from any claims, losses, damages, or liabilities arising from your use of the Services or violation of these Terms.

13. Modifications to Terms

 

We may update or modify these Terms at any time. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

14. Governing Law

 

These Terms are governed by the laws of the United States and the State of Delaware. Any disputes shall be resolved in the courts located within that State.
